§ 1 Scope and seller
(1) These terms and conditions apply to all orders placed via the online shop rungfield.com for delivery to the United Kingdom.
(2) Your contracting party is Rungfield – Marius Palluel, sole trader (entreprise individuelle), 60 Rue François 1er, 75008 Paris, France, SIRET 991 168 212 00017, email: contact@rungfield.com, phone: +33 7 56 86 06 84 (hereinafter ‘we’).
(3) Any differing terms of the customer are not recognised unless we expressly agree to their application.
§ 2 Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By clicking the order button in the final step of the ordering process, you place a binding order for the goods in the basket. Before submitting the order, you can check your entries at any time and correct them using the browser's functions or the correction fields in the ordering process.
(3) Immediately after submitting your order, you will receive an automatic acknowledgement of receipt by email, which does not yet constitute acceptance of your offer. The contract is concluded when we accept your order by a separate email (order confirmation or dispatch confirmation) or dispatch the goods. For payment methods where payment is triggered directly during the ordering process (e.g. PayPal, credit card), the contract is concluded as soon as the payment process is completed.
(4) The language of the contract is English. The text of the contract is stored by us; we will send you the order details and these terms and conditions by email. You can view the terms and conditions on this page at any time.
§ 3 Prices and delivery charges
(1) The prices stated at the time of the order apply. The prices are final prices. As a small business under Art. 293 B of the French Code général des impôts, we do not show VAT.
(2) Delivery to the United Kingdom is free of charge. Any differing delivery charges will be clearly displayed before the order is completed.
§ 4 Delivery
(1) We deliver to the United Kingdom. Delivery times are stated on the relevant product page and in our delivery information.
(2) If the goods ordered are not available, we will inform you without delay and promptly refund any payments already made.
§ 5 Payment
(1) The available payment methods are displayed during the ordering process.
(2) For purchases by instalments or on invoice via third-party providers, their terms also apply; the respective provider may carry out a credit check.
§ 6 Retention of title
The goods remain our property until payment has been made in full.
§ 7 Right to cancel
Consumers have a statutory 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Details can be found in our cancellation policy. You can also cancel using the ‘Cancel your contract’ button.
§ 8 Statutory warranty rights
The statutory rights under the Consumer Rights Act 2015 apply.
§ 9 Warranty
(1) In addition to your statutory rights, we as the seller grant a 5-year warranty on all ladders from the date of delivery. The warranty provider is Rungfield – Marius Palluel (for the address, see § 1).
(2) The warranty covers manufacturing and material defects, in particular a locking mechanism that no longer holds, sections that have play or jam, and assembly defects. It does not cover normal wear and tear (e.g. of the feet), damage caused by impacts, falls or the ladder tipping over, or damage caused by use beyond the load limit of 150 kg or contrary to the instructions for use.
(3) In the event of a warranty claim, we will repair or replace the ladder at our discretion. To make a claim, contact contact@rungfield.com quoting your order number; the invoice is sufficient as proof. Registration is not required.
(4) The buyer's statutory rights, in particular the statutory rights under the Consumer Rights Act 2015, are not restricted by the warranty; exercising them is free of charge.
§ 10 Liability
We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, and under applicable product liability law. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
§ 11 Dispute resolution
We are willing to take part in dispute resolution proceedings before the consumer mediation body CM2C, 14 rue Saint Jean, 75017 Paris, France.
§ 12 Applicable law
The law of the French Republic applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
